Waiver and Release
I do hereby agree to participate in the Equilibrado Orihinal System of Eskrima (referred to as “Organization”) located at the above stated location as “School Attending”. The responsible party must read the entire contract before signing.
I recognize the risks of injury that are common to any performing arts program that my child or I participate in and I do hereby waive and release the Organization from and against any and all claims, actions, causes of action, damages, costs, liabilities, expense of judgments, including attorney’s fees and court costs, that arise out of my participation in this program. I hereby execute this Waiver and Release form permitting my minor child and / or myself to participate in the Organization’s program.
I understand that the classes are based on a twelve month calendar year and that tuition for the (years) school session is based on a twelve month calendar year.
Students will average eight classes per month / per calendar year. Tuition and testing fees (if eligible) are due and must be paid on or before the 25th of each month, regardless of Student’s absence, major holidays, and / or school holidays. I understand that I will not receive a courtesy bill reminder, and that tuition not received by the first of each month will assess a late charge, starting at $15.00 at the discretion of the Organization. Returned checks will result in a $35.00 penalty fee. Be advised that it is the Student and / or Guardian’s responsibility to make sure payment is received on time. Delinquent accounts will be turned over to a collection agency. On-Line Bill Pay (PayPal) is the preferred method of receiving payment. The above stated “Start Date” locks the tuition rate and will not be increased for the duration of the contract. All fees are subject to an annual increase due to the cost of living.
I understand that Registration fees, tuition, equipment, camps, birthday parties, testing fees and private lessons are non-refundable. Tuition Fees must be paid in full for the duration of the contract whether the participant/student chooses to attend the offered classes or chooses to abstain from training. Tuition is determined on a monthly basis as membership with the Organization and not a “per-class” basis. Requesting pro-rated or partial tuition payments is not allowed. Once the term of the contract is complete, I (the student/practitioner) may continue my membership with the Organization on a month-to-month basis, or may enter into a new contract with the Organization.
Uniforms, equipment, camps, testing fees, private lessons, etc. are all additional costs and are not included in with tuition or registration. Students (Minors): it is the Parent and / or Guardians responsibility to bring the student into the building and to pick them up. We do ask that students come to class dressed and remain seated quietly, or line up quietly in the designated area prior to their scheduled class. Parents and family members are welcome to watch classes, but must be quiet and not disturb the students or staff.
By signing below indicates that you have read the Waiver and Release guidelines, terms and conditions, and regulations on this contract and fully understand the contents. This contract will remain on file in the Organization's Home Office unless the terms and conditions change. At that time a new contract will be executed.
Publicity and Photo Release Form
I hereby grant to the Equilibrado Orihinal System of Eskrima / McWethy Consulting LLC (Organization) the absolute and irrevocable right and unrestricted permission to use my name, likeness, image, voice, and/or appearance as such may be embodied in any photos, video recordings, audiotapes, digital images, and the like, taken or made on behalf of the Organization or its partners. I agree that the Foundation has complete ownership of such material and can use said material for any purpose consistent with the Foundation’s mission. These uses include, but are not limited to, videos, publications, advertisements, news releases, Web sites, and any promotional or educational materials in any medium. I acknowledge that I will not receive any compensation for the use of such images, video, likeness, etc.
I hereby release and discharge the Organization, and its agents, representatives and assignees from any and all claims and demands arising out of or in connection with the use of my name, likeness, image, voice and/or appearance, including any and all claims for invasion of privacy, right of publicity, misappropriation or misuse of image, and/or defamation. I represent that I am over the age of eighteen (18) years and that I have read the foregoing and fully understand its contents.* This release shall be binding upon me, my heirs, legal representatives, and assigns.
This agreement is being made and entered into under the laws of the State of Minnesota and shall be governed and interpreted in accordance with the laws of said state. This agreement embodies the entire agreement of the parties (subject and photographer/videographer). No modification of this agreement shall be of any effect unless it is made in writing and signed by all of the parties to the agreement.
